Privacy Policy

SKY Co., Ltd. (hereinafter referred to as “the Company”) establishes this Privacy Policy (hereinafter referred to as “this Policy”) regarding the handling of privacy information in connection with the services provided on this website (hereinafter referred to as “the Services”).

Article 1 (Privacy Information)

Among privacy information, “personal information” means personal information as defined in the Act on the Protection of Personal Information of Japan: information relating to a living individual that can identify a specific individual by name, date of birth, address, telephone number, contact details, or other descriptions contained in such information.

Among privacy information, “history information and characteristic information” means information other than “personal information” as defined above, including services used, products purchased, pages and advertisements viewed, search keywords entered by the user, dates and times of use, methods of use, usage environment, postal code, gender, occupation, age, the user’s IP address, cookie information, location information, and device identification information.

Article 2 (Collection of Privacy Information)

When a user registers to use the Services, the Company may ask for personal information such as name, telephone number, and email address. The Company may also collect from its business partners (including information providers, advertisers, and ad delivery destinations; hereinafter referred to as “Partners”) transaction records containing the user’s personal information and payment-related information arising between the user and Partners or similar parties.

With respect to users, the Company collects history information and characteristic information—such as services and software used, products purchased, pages and advertisements viewed, search keywords, dates and times of use, methods of use, usage environment (including, where the Services are used via a mobile device, the device’s communication status and various settings used for access), IP address, cookie information, location information, and device identification information—when the user uses the Company’s or a Partner’s services or views pages.

Article 3 (Purpose of Collecting and Using Personal Information)

The purposes for which the Company collects and uses personal information are as follows:

  1. To provide and operate the Company’s services
  2. To respond to user inquiries, including by using information related to the inquiry, other information necessary for the Company to provide services to the user, the user’s service usage status, and contact information
  3. To send notices or otherwise contact users by email, and to use contact information such as name and address in order to ship products or contact users as needed
  4. Purposes incidental to the purposes above

Article 4 (Provision of Personal Information to Third Parties)

Except in the cases set forth below, the Company will not provide personal information to third parties without the prior consent of the user. This does not apply where provision is permitted under the Act on the Protection of Personal Information or other applicable laws and regulations.

Where the Company has given prior notice or made a public announcement of the following:

  • That the purpose of use includes provision to third parties
  • The categories of data to be provided to third parties
  • The means or method of provision to third parties
  • That provision of personal information to third parties will be stopped upon request by the individual

Notwithstanding the preceding paragraph, the following cases shall not be deemed provision to a third party:

  1. Where the Company entrusts all or part of the handling of personal information within the scope necessary to achieve the purpose of use
  2. Where personal information is provided in connection with the succession of business due to a merger or other reason
  3. Where personal information is used jointly with a specific party, and the individual has been notified in advance, or is otherwise placed in a position to readily know, of that fact, the items of personal information to be jointly used, the scope of joint users, the purpose of use by the users, and the name of the person responsible for the management of such personal information

Article 5 (Disclosure of Personal Information)

When the Company is requested by an individual to disclose personal information, the Company will disclose it to that individual without delay. However, the Company may withhold all or part of the disclosure if disclosure would fall under any of the following, and if the Company decides not to disclose, it will notify the individual of that decision without delay.

  1. Where there is a risk of harm to the life, body, property, or other rights or interests of the individual or a third party
  2. Where there is a risk of significant interference with the proper conduct of the Company’s business
  3. Where disclosure would otherwise violate laws or regulations

Notwithstanding the preceding paragraph, as a general rule the Company will not disclose information other than personal information, such as history information and characteristic information.

Article 6 (Correction and Deletion of Personal Information)

If a user’s personal information held by the Company is incorrect, the user may request that the Company correct or delete such personal information in accordance with procedures prescribed by the Company.

If the Company receives a request under the preceding paragraph and determines that it is necessary to comply, the Company will correct or delete the personal information without delay and notify the user thereof.

Article 7 (Suspension of Use, etc. of Personal Information)

If an individual requests suspension of use or erasure of personal information (hereinafter referred to as “Suspension of Use, etc.”) on the grounds that the personal information is being handled beyond the scope of the purpose of use, or was obtained by unlawful means, the Company will conduct the necessary investigation without delay and, based on the results, carry out Suspension of Use, etc. of the personal information and notify the individual thereof.

However, where Suspension of Use, etc. would involve substantial cost or is otherwise difficult, and where alternative measures necessary to protect the individual’s rights and interests can be taken, the Company will take such alternative measures.

Article 8 (Changes to this Privacy Policy)

The contents of this Policy may be changed without notice to users. Unless otherwise specified by the Company, the revised Privacy Policy shall take effect from the time it is posted on this website.
